HC directs U’kashi SP to approve CCL to woman head constable

 The Uttarakhand High Court has directed the Uttarkashi superintendent of police to approve a 45-day leave to a woman police head constable to enable her to take care of her five-year old daughter. The single bench of justice Pankaj Purohit heard the petition of the woman posted as a head constable in the local intelligence unit in Uttarkashi. The petitioner has stated that she is a single parent and looks after her five-year-old daughter. Her daughter lives with her 70-year-old maternal grandmother.

Last month, the head constable had submitted an application for child care leave (CCL) on February 21. She had stated in her application that her daughter is suffering from a psychological problem. The daughter needs to stay with her mother in order to help her overcome the psychological issue. The petitioner stated that her application for the child care leave was rejected citing the ensuing Lok Sabha election.

The court stated that it is aware that the child care leave is not a right of the employee but is provided depending on the discretion and disposal of the appointing authority in case of government employees. However, the health of the petitioner’s daughter is not well and the court was of the opinion that the petitioner has the right to 45 days of child care leave in order to take care of her daughter. The HC has directed the Uttarkashi superintendent of police to approve the sought leave to the petitioner within three days.
