Petition questioning membership of MLA Kaida filed

The Bhimtal MLA has joined BJP but has not resigned yet from assembly

Aam Aadmi Party (AAP) leader and district panchayat member from Tehri, Amarendra Bisht has submitted a petition in the office of Secretary Uttarakhand Vidhan Sabha and requested that the MLA from Bhimtal, Ram Singh Kaida should be disqualified from the membership of the house. 

Kaida had recently joined Bharatiya Janata Party (BJP) but has not tendered his resignation from the membership of state assembly. In his complaint Bisht has said that Kaida was elected as an independent candidate from Bhimtal assembly constituency. He said that Kaida has become a member of BJP recently and under the provisions of schedule 10 of Indian constitution he is not eligible to continue as the member of the house. It is also against the eligibility conditions for being a member of the Uttarakhand assembly (anti defection law).
