HC seeks Govt clarification in one day on land use change

In a public interest litigation challenging the State government’s compounding by-laws for conversion of land use from residential to commercial without an amendment in Urban Planning and Development Act, the Uttarakhand high court has directed the State government to clarify the situation in one day. The PIL will be taken up for hearing next on May 6.

It is pertinent to mention here that retired town planner HC Ghildiyal had challenged the compounding by-laws in court, stating that under it permission for changing the land use for specific areas is being granted as a one time measure through a government order. The authority is granting permission to change the land use of residential area to commercial. However, according to section 30 of the Urban Planning and Development Act, the masterplan of any city cannot be changed without amendment in the Act. The HC division bench of justice Manoj Kumar Tiwari and justice RC Khulbe has directed the State government to clarify the situation.
