HC pulls up State for shifting site of NLU

The high court of Uttarakhand rejected the state government’s appeal seeking one year time for establishment of the national law university. Pulling up the state government for shifting the university location from Rudrapur to Dehradun district, the high court observed that this was contempt of the past order of the court. In its earlier order the high court had stated that the national law university should be established in Udham Singh Nagar district and that classes should be started by September 2018. Till the university building is facilitated, the academic work should begin in government of private building, the court had stated. However, instead of establishing the university at the said location, the state government decided to open it in Ranipokhri in Dehradun district with the chief minister also unveiling the foundation for it. It should be mentioned that the high court chief justice is the chancellor of the law university.

The high court questioned what was the need to shift the location of the university to Dehradun district when land had been identified for it in Udham Singh Nagar.

On Friday, the division bench of chief justice Ramesh Ranganathan and justice Lokpal Singh rejected the state’s appeal seeking additional time to act on the past orders of the court. The division bench was also informed in the case that a contempt petition is pending in the court.

Earlier, in a public interest litigation filed by Bhupal Bhakuni, the high court had directed the government to establish national law university at Parag Farm in Udham Singh Nagar district. The court had also directed the government to complete appointment of faculty and other staff for the university and start classes. However, about six months after these orders were issued, neither was the said land been transferred nor were the classes started. Following this, Bhakuni had filed a contempt petition, alleging that instead of establishing the national law university at Parag Farm, the government was attempting to sell the land.
