HC imposes Rs five lakh penalty for baseless petition

The Uttarakhand High Court imposed a Rs five lakh penalty on a petitioner after finding the petition challenging the appointment of registrar in the GB Pant Engineering and Technology College, Ghurdauri in Tehri district baseless. The court directed the petitioner to deposit the sum with the State Legal Services Authority within a period of six weeks and disposed of the case.
The matter was taken up for hearing on Tuesday by the division bench of chief justice G Narender and justice Subhash Upadhyay. According to the case details, Tehri resident Ajay Kishore Upadhyay had filed the petition in the High Court contending that Sandeep Kumar was not fit to continue as the registrar of the GB Pant Engineering the Technology College.
The petitioner had further contended that Kumar lacked the qualifications necessary as per the required standards. At least five years of experience and working in the academic session is required to handle the administration of the college, which Kumar lacks, the petitioner had claimed, to support his demand for his removal from the post of registrar.
Arguing against the petition, the counsel representing the college stated that the board of governors has the authority to appoint a person to the post, adding that the appointment to the post of the registrar had been made as per the rules in 2019.
The counsel pointed out that challenging the appointment six years after the appointment was made is against justice to support the demand for quashing the petition. After hearing the arguments, the court imposed a penalty of Rs five lakh on the petitioner and disposed of the petition.
