HC dismisses petition of enemy property occupants

Metropol compound residents had sought time to vacate property but refused to provide undertaking sought by court

The Uttarakhand High Court dismissed the petition filed by occupants of those living in the Metropol compound which was ascertained as enemy property, seeking time to vacate the property. During the hearing the petition of Mehmood Ali and other occupants on Friday before the division bench of chief justice Vipin Sanghi and justice Rakesh Thapliyal, the illegal occupants were unable to present any documentary evidence to support their claim of ownership. The petitioners acknowledged that they had handed over possession to the authorities in 2010 and that they are illegal occupants. They sought time from the court to vacate the property following which the HC asked them to provide an undertaking to the effect that they would vacate the property within 10 days. The occupants refused to provide an undertaking, after the court dismissed their petition.
