High Court issues notice to ex-CM Khanduri in PIL
PIL questions facilities provided to Ex-Chief Minister
The High Court of Uttarakhand has issued notices to former Chief Minister and current MP, Bhuwan Chandra Khanduri by personal service because he has not responded to the earlier notices of the court issued to him by registered post.
The HC has also indicated that if he will not respond to this, the court may issue paper publication to serve the notice to him.
This development took place during the hearing of a public interest litigation filed by the Rural Litigation and Entitlement Kendra (RLEK) questioning the facilities provided to former Chief Ministers.
The matter was taken up for hearing by the division bench of chief justice Ramesh Ranganathan and justice Lok Pal Singh.
According to advocate for the petitioner, Kartikey Hari Gupta, the rent calculation of the Government bungalow had been done illegally and on the basis of one Government order of the year 2004 and on the basis of 1997 Rules which have already been declared unconstitutional by the Supreme Court.
The HC examined the method of rent calculation done by the State Government and expressed its surprise on the Government calculating the rent based on the 2004 Government order.
The petitioner has also objected to the meager rent paid by former CMs Vijay Bahuguna and Ramesh Pokhriyal ‘Nishank’ and pointed out that their payment is not in accordance with the Supreme Court order which said to recover “appropriate rent” and also the High Court order of 2017 which directed the State Government to calculate the “market rent” which this Government has not calculated till date.
Gupta further informed that the HC has made it clear that it is public money and all dues have to be recovered from them.
The court has given ten days to serve notices personally on Khanduri and fixed the matter for hearing after ten days. read more posts…
